Court differs from Perak decision as Gobind remains barred

KUALA LUMPUR, Oct 22 — Puchong MP Gobind Singh Deo remains barred from the Dewan Rakyat after the High Court ruled today that legislative proceedings cannot be challenged in court, in a decision which appears to go against an earlier Federal Court ruling.

The decision by the High Court today relies on a generally accepted principle of Separation of Powers but contradicts a Federal Court ruling in April which said it was allowed to inquire into legislative proceedings.

The Court ruled today that the constitution was supreme and that it cannot question proceedings of the Dewan Rakyat.

Suit against Dr M dismissed

KUALA LUMPUR: The Court of Appeal has allowed an application by Tun Dr Mahathir Mohamad to strike out Datuk Seri Anwar Ibrahim’s appeal on his RM100mil defamation suit against the former Prime Minister.

This means that Anwar’s appeal, which was to have been heard on Nov 2 in the Court of Appeal, has been dismissed.

The court’s three-man bench, comprising Justices Abdul Malik Ishak, Azhar Maah and Syed Ahmad Helmy Syed Ahmad, made the unanimous ruling after standing-down for an hour to deliberate on the matter.

IPOH: The Kinta Royal Wetlands in Batu Gajah is under threat and will lose the largest heronry in the country if illegal and incompatible activities continue.

A recent check by the Malaysian Nature Society (MNS) revealed that someone had fenced up the whole lake where the heronry, with five breeding species of 2,000 waterbirds, is located.

MNS Perak Bird Group coordinator Lim Kim Chye believes that the fence was put up by parties interested to use the pond for commercial fish farming.

KUALA LUMPUR, Sept 15 (AFP) — A Malaysian Islamic court has sentenced an Indonesian man to be caned and jailed for drinking alcohol, weeks after triggering a furore by ordering a woman to be caned for the same offence.

The Sharia High Court in central Pahang state on Monday sentenced odd-job worker Nazarudin Kamaruddin to six strokes of the cane and one year’s imprisonment, a court official confirmed.

“The sentence meted out to him is not meant as punishment but to serve as a lesson,” judge Abdul Rahman Yunus said according to the New Straits Times, adding that Nazarudin had dishonoured the holy month of Ramadan.

Malaysia, a multicultural country with large Chinese and Indian communities, has a dual-track legal system and sharia courts can try Muslim Malays — who make up 60 percent of the population — for religious and moral offences.

In some parts of the country it is a punishable offence for Malays to drink alcohol. They can be fined, caned, or jailed for up to three years but prosecutions have until now been extremely rare.

The case of Kartika Sari Dewi Shukarno, a part-time model who in July was sentenced by the Pahang court to six strokes of the cane for drinking beer, was sharply criticised by human rights groups.

As international headlines mounted, jeopardising Malaysia’s reputation as a moderate nation, the government last month announced her sentence would be reviewed, saying it was “too harsh”.

Nazarudin, a 46-year-old permanent resident of Malaysia, said he had bought a bottle of “samsu”, a cheap local liquor, to share with friends at a restaurant when religious authorities swooped in a raid.

“I’ve been in this country for so many years and have been very careful not to get onto the wrong side of the law,” he told the paper. (AFP)

Developers given three months to hand over strata titles

DEVELOPERS in Kuala Lumpur have been given three months to hand over strata titles to the respective owners or they stand to face legal action.

According to Kuala Lumpur mayor Datuk Ahmad Fuad Ismail, the drastic move is one of the many measures to resolve the strata titles problem.

He said the decision was made after the Kuala Lumpur City Hall (DBKL) discussed the matter with the Housing and Local Government Ministry and the Land and Mines Office.

The penalty for failure to adhere to the ruling is a maximum fine of RM20,000 or a three-month jail term.

Fuad said under the Building and Common Property (Management and Maintenance) Act, a developer had to give the strata title to an owner within a year.

According to Fuad, so far only 75,665 strata titles have been given for residential and commercial properties in KL.

Of the 44,168 developers in KL, 40% are still having the strata titles while 30% were given to the joint management bodies (JMBs). The remaining 30% of owners already have their strata titles.

“We will also talk to the owners about the management fees so that the operations can be carried out smoothly,” Fuad said.

“Developers should be aware of the legal requirements to expedite the handing over of the strata titles. The mayor acts as the commissioner of buildings in resolving the matter as stipulated under the law,” he said.

Fuad said the developers were fast in releasing the titles of low-cost units but slow with high-cost developments.

Under the jurisdiction of the DBKL, there are 236,421 high-rise units, of which 209,882 are residential and 26,539 commercial.
